Book excerpt: The development of private law across the common law world is typically portrayed as a series of incremental steps, each one delivered as a result of judges dealing with marginally different factual circumstances presented to them for determination. This is said to be the common law method. According to this process, change might be assumed to be gradual, almost imperceptible. If this were true, however, then even Darwinian-style evolution – which is subject to major change-inducing pressures, such as the death of the dinosaurs – would seem unlikely in the law, and radical and revolutionary paradigms shifts perhaps impossible. And yet the history of the common law is to the contrary. The legal landscape is littered with quite remarkable revolutionary and evolutionary changes in the shape of the common law. The essays in this volume explore some of the highlights in this fascinating revolutionary and evolutionary development of private law. The contributors expose the nature of the changes undergone and their significance for the future direction of travel. They identify the circumstances and the contexts which might have provided an impetus for these significant changes. The essays range across all areas of private law, including contract, tort, unjust enrichment and property. No area has been immune from development. That fact itself is unsurprising, but an extended examination of the particular circumstances and contexts which delivered some of private law's most important developments has its own special significance for what it might indicate about the shape, and the shaping, of private law regimes in the future.

Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 1971 Evolution – Revolution is an interdisciplinary volume examining inquiry around the central topic of evolution and revolution. Containing contributions from a number of eminent academics of the time, the book addresses the meaning and application of evolution and revolution in the context, not of what things are, or even how they behave, but how they become. The broad interdisciplinary range of essays explores this concept through the idea of development and change and argues that both change, and development must be measured against concepts of flux and that which endures. The editors of the book suggest that these are the ‘invariants’ which contemporary thinkers are beginning to accept as the process-counterparts of Platonic ‘immutables’. Thus this volume examines the two ‘immutables’ of evolution and revolution. The book covers the concept through essays in science, philosophic concepts of rationalism and existentialism, art and religion.

Book excerpt: In a hard-hitting book that refutes conventional wisdom, Katherine Sender explores the connection between the business of marketing to gay consumers and the politics of gay rights and identity. She disputes some marketers'claims that marketing appeals to gay and lesbian consumers are a matter of "business, not politics" and that the business of gay marketing can be considered independently of the politics of gay rights, identity, and visibility. She contends that the gay community is not a preexisting entity that marketers simply tap into; rather it is a construction, an imagined community formed not only through political activism but also through a commercially supported media. She argues that marketing has not only been formative in the constitution of a GLBT community and identity but also has had significant impact on the visibility of gays and lesbians.

Book excerpt: Your reality is poised to be better than you can imagine... if you awaken within the architected systems and reclaim your Inner Self. Across the globe, humanity is awakening spiritually. This evolvement offers a new-found ability to see through and beyond the surface reality that those controlling the global landscape have constructed for us. Instead of getting stuck in fear, anger and hopelessness, we can unite in a higher vision that will heal ourselves and our planet. Awakening Within the System provides key answers for this transformational shift. Nathan Z Townley provides a deeply spiritual look into the well-hidden forces that have shaped our reality, beliefs and experiences for many centuries. More importantly, he presents us with a fresh, extremely hopeful and uplifting glimpse into the grand finale that is taking place right now and will lead all who choose to a brand new platform of experience. Are you ready for humanity's leap into the new 5D paradigm? How does this new paradigm look and feel? How is it different from our current existence? What has to change for us to move forward into lives and restructured global systems that are truly seated in love, peace, oneness, transparency and prosperity for all people? If you are searching for answers in these seemingly chaotic times, this book can help trigger the remembrance of who you really are and why you chose to be here in this lifetime. Our collective awakening will render a brand new humanity that honors its divine blueprint and true capacity as Beings of Light. Are you ready to awaken within the system?
